Controversy over number of MPs

Before the completion of the term of the 11th parliament, a debate started in politics about the swearing-in of the members of the twelfth parliament. Complaints have been raised from the opposition political camp that two parliaments are running in the country now. The 11th Parliament was not dissolved. The twelfth has also been sworn in. That is, the number of MPs is 648. There are two MPs in each constituency. They allege that taking the oath of MPs and ministers after 19 days is a violation of the constitution. Related experts also say that the spirit of the constitution is that there will be one member of parliament for an area. They are both in the areas where the new MPs have been elected. The term of the 11th Parliament has not ended yet. Parliament was not abolished. Such a controversy would not have arisen if the President had dissolved the 11th parliament before the swearing-in of the new members of Parliament. What is the answer to the question now?

This debate should end. When asked, Liberal Democratic Party (LDP) President Oli Ahmed said that the eleventh parliament is still there, those who are in the twelfth parliament have also been sworn in. Two governments are running simultaneously in the country. Because the eleventh parliament has not been dissolved yet. The term of the 11th Parliament is up to January 29. Ever since the Awami League government came to power, it has never respected the law or the constitution. No government followed the Constitution, no government left, they did not care about these rules. It is not important to them. They aim to stay in power by any means necessary.

To rule the people unjustly. Determining one's destiny through corruption. The whole nation has seen how they became members of parliament through false voting in polling stations. And, how many times the wealth of those who were there before has increased? There is no point in talking about the law with this government. They don't follow any law. Ruhul Kabir Rizvi, Senior Joint Secretary General of the Bangladesh Nationalist Party (BNP) said, Human rights, constitution, and democracy have been alive postmortem by muscle power.

Article 72 (3) of the Constitution states that Parliament shall be dissolved after five years have elapsed from the date of its first meeting unless the President has dissolved it earlier. Since the President did not dissolve Parliament, it means that those who were members of the 11th Parliament till January 29 are still members of Parliament. He said legal experts in the country say that at the moment there are 350 members of the Midnight 11th Parliament and 298 members of the Dummy 12th Parliament, totaling 648 sworn MPs in the country.

Now when the president calls the parliament, both the members of the parliament can attend it. But it is constitutionally illegal. This anarchy will continue until the end of the term of the 11th Parliament on January 29. This is a gross constitutional violation. In the interests of democracy and the country, the High Court can cancel the twelfth illegal parliament during this period. People hope last resort courts can play their groundbreaking role.

He also said that currently, two parliaments are in place, that is, there are now two MPs in each seat! Really Selucas, what a strange country the government has made. The people of the country are not obliged to obey the illegal proceedings of the illegal parliament and any unjust orders of the illegal council of ministers, born illegally by illegal oaths that deviate from the constitution. This is the reason why the whole regime of the Awami League is affected by corruption, big loot, big wealth smuggling, and big mafia circles. When asked, the senior lawyer of the Supreme Court Manzil Morsed said, "In my view, this discussion could have been eliminated if the President had dissolved the 11th Parliament before the swearing in of the new parliamentarians."

By not doing this, the 11th Parliament remained and the twelfth parliament remained. Therefore, a controversy has arisen about it. He said the spirit of the constitution is that there will be one member of parliament for an area. They are both in the areas where the new MPs have been elected. The term of the 11th Parliament has not ended yet. Parliament was not abolished. This is the reality. He said many MPs became ministers after taking oath. After taking the oath, he became a member of Parliament. Maybe the first session has not started.

That's a different thing. But after being recognized as a member of parliament, he was made a minister. Because to become a minister, 90 percent must be a member of parliament. And 10 percent are technocrats. Out of the 10 percent who became ministers, all became MPs. What is the answer to this question? This debate should end. amaat-e-Islami's propaganda secretary and Supreme Court lawyer Matiur Rahman Akand said that the first thing is that the constitution of Bangladesh states that there will be a parliament in the country. There is no mention of two parliaments. The time of the 11th Parliament is till the 29th. But now the number of parliamentarians in the country is 648 as the twelfth parliament has taken oath. Which is legally unconstitutional.

BNP Joint Secretary General Barrister AM Mahbub Uddin Khokon said that the ruling party Awami League does not follow the law and constitution. The tenure of the MPs who were elected in the night polls was less than five years. Now that 300 MPs have taken the oath again, where is the validity of it? Now it has become 600 MP. How was the oath taken by the ministers if they were not MPs? Article 72(3) of the Constitution states that the Parliament shall be dissolved after five years have elapsed from the date of the first sitting unless dissolved by the President.

Then the previous parliament was not broken. Five years have not passed. Because, the first meeting of the 11th National Parliament was held on January 29, 2019. Addressing the speaker of the national parliament, this lawyer said, "The speaker is a law student." You should have a good understanding of the Constitution. I believe you do. What do you do with 72(3)? MPs were sworn in 19 days ago. What will happen to the previous 300 MP? They have no constitutional validity. On January 10, the MPs took oath and the 11th cabinet was formed. 10 percent technocrat ministers in the cabinet. Many took oaths as new MPs and became ministers. The cabinet has no legitimacy. I think it is unconstitutional. Now 600 MP. It is illegal. If there is respect for the constitution and the rule of law, the prime minister, cabinet members, and 300 MPs should resign immediately. Otherwise, the constitution will be violated. It amounts to treason. They should be prosecuted.
